1. Applicability of These Terms and Conditions

1.1 Welcome to the website of the Wispe Brewery. These General Terms and Conditions, together with the Disclaimer on our website (www.wispe.nl and www.wispe.com), apply to all our offers and the purchases you make as a consumer via the Website.

1.2 Before entering into a distance purchase via the Website, you will be asked to agree to these Terms and Conditions. If you do not accept them, you will not be able to purchase products via the Website.

1.3 These Terms and Conditions are made available to you in such a way that you can easily save them on a durable data carrier. Upon request, these Terms and Conditions will be sent to you electronically or otherwise free of charge.

1.4 We recommend that you print and save these Terms and Conditions or store a digital copy. We may update these Terms from time to time. The version applicable when you place a new order will be the applicable version. Please consult the then-current version of these terms each time you place an order.

3. Our Products

3.1 You must be at least 18 years old to place an order. The person receiving the order must also be at least 18 years old (see article 5.3).

3.2 Current product prices are listed on the Website. Prices include VAT unless stated otherwise. Delivery costs are charged depending on the number of products ordered. Delivery and any additional costs are listed on the Website. If you do not agree to these charges, you can cancel the ordering process. By completing the order, you agree to pay the total price including delivery.

3.3 Prices listed during the validity period of an offer will not be increased, except for changes in VAT or other legal regulations. Exceptions apply to products or services subject to market fluctuations beyond our control, which may be offered at variable prices.

4. Conclusion of the Agreement and Payment

4.1 The agreement is concluded when we receive your order through the Website’s order form and you meet the conditions. You can check and correct your data during the ordering process. Please read and review each page carefully. You may order multiple products at once. We reserve the right to refuse orders with varying delivery times.

4.2 Payment methods are listed on the order pages. The general terms and conditions of the payment service provider (Mollie BV) apply to the payment process.

4.3 Payment is due upon conclusion of the agreement. The order will not be processed until payment is received.

4.4 After receiving your order, we will send a confirmation email (the “Confirmation Email”). You can print and save it. If you do not receive a confirmation email within one working day, the agreement has not been concluded. Please contact us via the contact form on our Website.

4.5 We may, within legal limits, verify your ability to fulfill payment obligations and assess other relevant factors. Based on this assessment, we may refuse an order or attach special conditions.

4.6 All products on the Website are available while supplies last. If a product is no longer available, we reserve the right to cancel the purchase and will inform you accordingly.

5. Delivery / Pickup

5.1 Delivery will take place at the Dutch address you provide on the order form. Wispe does not deliver to P.O. boxes or reply numbers.

5.2 Accepted orders of in-stock items will be processed as soon as possible and no later than 15 days after receipt of payment, unless otherwise agreed. Delivery is handled by a postal or courier company. During peak times, delivery times may vary. We are not liable for delays or incorrect deliveries caused by the carrier. Contact Wispe Brouwerij B.V. for applicable carrier terms.

5.3 The recipient must be at least 18 years old. The courier may request identification. If no adult is available to accept delivery, the courier may refuse delivery and/or attempt again later without obligation.

5.4 For pickup orders, the standard delivery time is 3–5 business days, unless otherwise stated. Pickup is possible during shop opening hours. Our address, contact details, and opening hours are listed on our Website. Bring the confirmation email and valid ID to verify you are at least 18 years old.

6. Right of Withdrawal for Consumers

6.1 If you are a consumer, you may withdraw from the purchase agreement within 14 days without giving any reason. You may optionally provide a reason. Notify us by email (info@wispe.nl) or registered letter (see 2.1) and include: name, address, order number, and reason (optional).

6.3 After receiving your request, Wispe will contact you to arrange the return. Return costs are borne by the consumer. Products must be returned in good condition: complete, unused, undamaged, and unopened (for drinks). Preferably in original packaging and with receipt or invoice.

6.4 Returns must be made within 14 days of arrangement. The following items are excluded:

a. Sealed products that are unsuitable for return due to health/hygiene reasons and whose seal has been broken (e.g., Wispe beer bottles, kegs)
b. Custom-made products
c. Gift cards
d. Other exceptions as per Dutch Civil Code Article 6:230p

6.5 Clothing can be exchanged for a different size in-store, subject to availability.

7. Consequences of Returns or Withdrawal

7.1 If returned due to defect, we will send a replacement free of charge. In such cases, the original price and shipping costs will not be refunded.

7.2 If you withdraw from the agreement per Article 6 and do not want a replacement, we will refund the full amount paid, including delivery costs, once we receive the returned items in good condition.

7.3 We will contact you regarding the refund method, unless we use the original payment method.

8. Intellectual Property Rights

8.1 The content of this Website, including data, images, audio, text, apps, and software, is protected by copyright, trademark, and database rights. These rights belong to Wispe Brouwerij B.V., an affiliated entity, or the relevant rights holders.

8.2 You may only use the Website in accordance with these Terms. Without written permission from Wispe, you may not reproduce, copy, create derivative works from, or exploit any part of this site.

9. Aansprakelijkheid

9.1 Emails and other internet communications are intended solely for the recipient. Use by others is not permitted. Wispe is not responsible for transmission accuracy or timeliness.

9.2 Images are for illustrative purposes only. We strive for accuracy but cannot guarantee exact color display. Obvious mistakes or errors do not bind us.

10. Indemnity

10.1 By using the Website, you indemnify Wispe from any claims arising from your breach of these Terms.

11. Final Provisions

11.1 Complaints regarding the agreement must be reported promptly and clearly by email to info@wispe.nl.

11.2 Articles 6 and 7 do not apply to buyers acting for commercial, professional, or business purposes.

11.3 Wispe may transfer its rights and obligations under the agreement to a third party.

11.4 All offers and agreements are governed exclusively by Dutch law.
